Zus\u00e4tzlich zu verg\u00fcten sind besondere, bei Vertragsschlu\u00df nicht vorhersehbare Leistungen und Aufwendungen. Gleiches gilt, wenn der Leistungsumfang druch den Absender nach Vertragsschlu\u00df erweitert wird.<\/p>\n<h2>Trinkgelder<\/h2>\n<p>Trinkgelder sind mit der Rechnung des M\u00f6belspediteurs nicht verrechenbar.<\/p>\n<h2>Erstattung der Umzugskosten<\/h2>\n<p>Soweit der Absender gegen\u00fcber einer Dienststelle oder einem Arbeitgeber einen Anspruch auf Umzugskostenverg\u00fctung hat, weist er diese Stelle an, die vereinbarte und f\u00e4llige Umzugskostenverg\u00fctung abz\u00fcglich geleisteter Anzahlungen oder Teilzahlungen auf entsprechende Anforderung direkt an den M\u00f6belspediteur auszuzahlen.<\/p>\n<h2>Transportsicherungen<\/h2>\n<p>Der Absender ist verpflichtet, bewegliche oder elektronische Teile an hochempfindlichen Ger\u00e4ten wie z.B. Waschmaschinen, Plattenspieler, Fernseh-, Radio- und Hifiger\u00e4ten, EDV-Anlagen fachgerecht f\u00fcr den Transport sichern zu lassen. Zur \u00dcberpr\u00fcfung der fachgerechten Transportsicherung ist der M\u00f6belspediteur nicht verpflichtet.<\/p>\n<h2>Elektro- und Installationsarbeiten<\/h2>\n<p>Die Leute des M\u00f6belspediteurs sind, sofern nichts anderes vereibart ist, nicht zur Vornahme von Elektro-, Gas-, D\u00fcbel- und sonstigen Installationsarbeiten berechtigt.<\/p>\n<h2>Handwerkervermittlung<\/h2>\n<p>Bei Leistungen zus\u00e4tzlich vermittelter Handwerker haftet der M\u00f6belspediteur nur f\u00fcr sorgf\u00e4ltige Auswahl.<\/p>\n<h2>Aufrechnung<\/h2>\n<p>Gegen Anspr\u00fcche des M\u00f6belspediteurs ist eine Aufrechnung mit mit f\u00e4lligen Gegenanspr\u00fcchen zul\u00e4ssig, die rechtskr\u00e4ftig festgestellt oder unbestritten sind.<\/p>\n<h2>Abtretung<\/h2>\n<p>Der M\u00f6belspediteur ist auf Verlangen des Ersatzberechtigten verpflichtet, die ihm aus dem von ihm abzuschlie\u00dfenden Versicherungsvertrag zustehenden Rechte an den Ersatzberechtigten abzutreten.<\/p>\n<h2>Missverst\u00e4ndnisse<\/h2>\n<p>Die Gefahr des Mi\u00dfverst\u00e4ndnisses anderer als schriftlicher Auftragsbest\u00e4tigungen, Weisungen und Mitteilungen des Absenders und solche an andere zu ihrer Annahme nicht bevollm\u00e4chtigte Leute des M\u00f6belspediteurs hat der letztere nicht zu verantworten.<\/p>\n<h2>Nachpr\u00fcfung durch den Absender<\/h2>\n<p>Bei Abholung des Umzugsgutes ist der Absender verpflichtet, nachzupr\u00fcfen, dass kein Gegenstand oder keine Einrichtung irrt\u00fcmlich mitgenommen oder stehengelassen wird.<\/p>\n<h2>F\u00e4lligkeit des vereinbarten Entgelts<\/h2>\n<p>Der Rechnungsbetrag ist bei Inlandstransporten vor Beendigung der Entladung, bei Auslandstransporten vor Beginn der Verladung f\u00e4llig und in bar oder in Form gleichwertiger Zahlungsmittel zu bezahlen.<\/p>\n<p>Barauslagen in ausl\u00e4ndischer W\u00e4hrung sind nach dem abgerechneten Wechselkurs zu entrichten. Kommt der Absender seiner Zahlungsverpflichtung nicht nach, ist der M\u00f6belspediteur berechtigt, das Umzugsgut anzuhalten oder nach Beginn der Bef\u00f6rderung auf Kosten des Absenders einzulagern. \u00a7 419 findet entsprechende Anwendung.<\/p>\n<h2>Lagervertrag<\/h2>\n<p>Im Falle der Lagerung gelten die Allgemeinen Lagerbedingungen des Deutschen M\u00f6beltransports (ALB). Diese werden auf Verlangen des Absenders zur Verf\u00fcgung gestellt.<\/p>\n<h2>Gerichtsstand<\/h2>\n<p>F\u00fcr Rechtsstreitigkeiten mit Vollkaufleuten auf Grund dieses Vertrages und \u00fcber Anspr\u00fcche aus anderen Rechtsgr\u00fcnden, die mit dem Transportauftrag zusammenh\u00e4ngen, ist das Gericht, in dessen Bezirk sich die vom Absender beauftragte Niederlassung des M\u00f6belspediteurs befindet, ausschlie\u00dflich zust\u00e4ndig.
